Flag Prospect Series
Coach Access Agreement
Operated by Bright Sports & Entertainment, LLC · Version: October 2026
Plain-Language Summary
In plain English, here is what you agree to when you get a Flag Prospect Series (FPS) coach account:
- You are a real coach, scout, or recruiting staff member, and what you tell us about yourself and your program is accurate.
- You will use athletes' information only to evaluate and recruit them — never to sell, advertise, build lists, or share outside your program.
- You will follow all recruiting rules that apply to you (NCAA, NAIA, NJCAA, your state association, conference, and school) when you contact athletes and families.
- The athletes are minors. You will treat their information with care and communicate with them and their families appropriately and safely.
- You will keep your login private, will not scrape or copy data from the platform, and will report any misuse.
- We can suspend or remove your account if these terms are broken.
The plain-language summary is for convenience only and does not replace or limit the full agreement below.
1. Parties and Acceptance
This Coach Access Agreement ("Agreement") is between Bright Sports & Entertainment, LLC, a Florida limited liability company operating as Flag Prospect Series ("FPS," "we," "our," or "us"), and the individual applying for or holding a coach account on the FPS platform ("Coach," "you"). By submitting a coach application, checking the acceptance box, or using a coach account, you agree to this Agreement. It works together with our Privacy Policy and, for the athletes whose information you see, the Registration Terms their parents accepted.
2. Who May Hold a Coach Account
A coach account is for a person who is currently employed or engaged as a coach, scout, or recruiting staff member of the school, club, or program they identify in their application. You represent that everything you submit to us, including your name, title, email address, program, and any staff-page link, is accurate and that you will keep it up to date. We may verify your information and may approve, deny, or revoke any account at our sole discretion.
Your account is personal to you. Do not share your login with anyone, including other coaches or staff at your program. Each person who needs access should apply for their own account.
3. Permitted Use of Athlete Information
The platform gives you access to information about athletes, most of whom are minors, including names, graduation years, positions, schools, academic information, testing results, and video. You may use this information only to evaluate athletes and to recruit them for your program. In particular, you agree that you will not:
- sell, rent, license, or otherwise share athlete information with anyone outside your own program staff who have a genuine need to see it and who are bound by this Agreement;
- use athlete information for advertising, marketing, fundraising, camp or clinic solicitation, or any purpose other than evaluating and recruiting athletes;
- copy, scrape, download in bulk, or build lists or databases from the platform, or use automated tools to collect data from it;
- use athlete information, video, or images to train artificial intelligence or machine learning systems;
- post, publish, or share athlete information, video, or screenshots publicly, including on social media, without the express written consent of the athlete's parent or guardian; or
- attempt to identify, locate, or contact an athlete or family through means other than those the platform and the applicable rules permit.
3A. Your Watch List and Notes
Your watch list and the notes you keep on athletes are private to you and are not shown to athletes, families, or other coaches. Keep notes professional and factual. FPS may access this information where needed to operate, secure, and support the platform and to produce aggregate statistics that do not identify you or any athlete.
4. Compliance With Recruiting Rules
You are solely responsible for complying with every rule that applies to your recruiting, including those of the NCAA, NAIA, NJCAA, any conference, your state athletic association, and your institution, including rules about when, how, and how often you may contact prospective athletes and their families. FPS does not monitor or verify your compliance, and access to the platform does not mean any contact is permitted. If a rule restricts contact with an athlete, you will not contact them.
5. Protecting Minors
You agree to communicate with athletes and families respectfully and professionally and to follow all applicable safe-sport, child-protection, and mandatory-reporting requirements, including any background screening your institution or governing body requires. You will not request personal or private images or information from an athlete, seek private contact outside appropriate channels, or engage in any conduct that is inappropriate, harassing, or unsafe toward a minor. FPS may immediately suspend or remove any account involved in such conduct and may report it to the appropriate authorities.
6. Confidentiality and Security
Keep your password confidential and use a strong, unique one. Tell us promptly at info@flagprospectseries.com if you believe your account has been accessed without permission or that athlete information has been exposed. When you no longer have a legitimate recruiting reason to hold information you obtained from the platform, or when we or a parent ask, you will stop using it and delete any copies you made.
7. Your Profile Content
You are responsible for the content you add to your profile, such as your biography, photo, school logo, and social media links, and you confirm you have the right to use it. You grant FPS a non-exclusive, worldwide, royalty-free license to display it on the platform, including in the coach directory and, for a school you approve, on the FPS website.
8. FPS Platform and Data
The FPS platform, the FPS Score and its methodology, the data collected at FPS events, and the structure and compilation of the information on the platform belong to FPS or its licensors. This Agreement gives you a limited, revocable, non-transferable right to use the platform for the purposes described above and no other rights. You will not reverse engineer, interfere with, or circumvent the security or access controls of the platform.
9. Accuracy and No Guarantees
Information entered by athletes and families, such as GPA, test scores, and biographies, is self-reported unless the platform labels it as verified, and may be incomplete or out of date. FPS makes no promise about the accuracy, completeness, or availability of any information, and does not guarantee any recruiting result. You are responsible for your own evaluation and decisions.
10. Suspension and Termination
We may suspend or end your access at any time, with or without notice, including if we believe you have broken this Agreement, misused athlete information, or put an athlete at risk. You may stop using the platform and ask us to close your account at any time. Sections that by their nature should continue after termination, including those on permitted use, confidentiality, and liability, will continue.
11. Limitation of Liability and Indemnity
To the fullest extent permitted by law, the platform is provided "as is," and FPS and its owners, officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the platform or from information on it. FPS's total liability to you for any claim relating to this Agreement is limited to one hundred dollars ($100). You agree to indemnify and hold harmless FPS and its owners, officers, employees, and contractors from any claim, loss, or expense, including reasonable attorneys' fees, arising from your breach of this Agreement or your misuse of athlete information.
12. Dispute Resolution and Governing Law
The parties will first try to resolve any dispute informally by written notice to the other party and 30 days of good-faith negotiation. If it is not resolved, it will be decided by binding arbitration administered by the American Arbitration Association under its applicable rules, in Brevard County, Florida, or virtually if both parties agree, on an individual basis only and not as a class or representative action. This Agreement is governed by the laws of the State of Florida without regard to conflict-of-law rules. Either party may seek emergency injunctive relief from a court to prevent irreparable harm, including to stop misuse of athlete information.
13. General
This Agreement is the entire agreement between you and FPS about coach access and replaces any earlier understanding on that subject. If any part is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. We may update this Agreement; we will notify coaches of material changes, and continuing to use the platform after notice means you accept the updated version.
